WARN

The strength of your business and the employment you provide are critical factors in the success of New Hampshire's economy and way of life. As such, we provide the following information for three important reasons:
  1. To let you know about obligations by Federal Law under the Workers Adjustment and Retraining Notification (WARN) act.
  2. To encourage compliance, whether or not your situation is covered under the Federal law.
  3. To recommend working with the NH Division of Economic Development to avoid layoffs and closure situations beforehand whenever possible.
WARN requirements apply when companies are planning any plant closing or mass layoff under certain circumstances. The key points of the law are:
  1. Businesses employing 75 or more full-time workers are required to comply; for smaller businesses, compliance is voluntary but recommended.
  2. A minimum of sixty days advance notice is required.
  3. The notice should be given to workers who are permantly laid off, to those expected to be laid off for 6 months or more, and to those whose work hours are reduced by 50% or more in each month of a 6-month period.
The following employer procedure is mandatory for qualified layoff events:
  1. Notify the professional association, union representative, or each individual worker, of the pending plant closure/layoff.
  2. Notify the chief elected official of the affected city or town.
  3. Notify the NH Director of the Rapid Response Team at the following address:
